Introduction:

Adding a spouse to a property deed is a significant decision. It provides legal protection and financial rights to your partner regarding the property. This article will guide you through the nine steps to add your spouse to a deed.

Step 1: Review the current deed

Begin by locating and reviewing your current property deed. Make sure you thoroughly understand the terms, conditions, and restrictions on it.

Step 2: Research your state’s laws

Each state has its own laws and regulations pertaining to property deeds. Research your state’s rules concerning adding names, or consult an attorney for guidance.

Step 3: Determine the type of tenancy

Decide on the type of tenancy between you and your spouse. Common choices include joint tenancy with rights of survivorship and tenancy in common.

Step 4: Obtain a blank deed form

To add a spouse to your existing deed, you’ll need a new deed form. You can obtain one from your local county recorder’s office or download it from their website.

Step 5: Complete the new deed form

Carefully fill out the new deed form. Include pertinent information, such as your current name as grantor, your spouse’s name as grantee, and the legal description of the property.

Step 6: Decide on ownership percentage

If you’re opting for a tenancy in common arrangement, agree on what percentage of ownership each spouse will hold.

Step 7: Prepare necessary paperwork

Some states require additional paperwork when transferring property between spouses. This can include tax forms or affidavits attesting to the relationship. Research your local requirements as needed.

Step 8: Notarize the new deed

Signatures on property deeds must be notarized in most states. Bring valid photo identification and find a notary public who can validate your signatures.

Step 9: Record the new deed

Finally, submit your completed and notarized new deed to the county recorder’s office. They will update the records and provide you with a stamped copy of your new deed.

Conclusion:

By following these nine steps, you can successfully add your spouse to your property deed, ensuring they have a legal stake in your shared home. It is crucial to carefully research all relevant state laws and seek professional advice when necessary.
