How to Do a Title Search: 10 Steps

A title search is an essential part of any real estate transaction – it helps you uncover potential issues with the property and ensure a clear title transfer. This process can seem daunting, but with these 10 steps, you’ll be able to conduct a title search with confidence.

1. Understand the purpose of a title search: A title search is intended to uncover any liens, easements, or other encumbrances on a property that could affect your ownership rights or hinder your ability to transfer the title.

2. Gather necessary information: To begin your search, you’ll need the property’s address and the current owner’s name. If possible, obtain the legal description of the land as well.

3. Visit your local County Recorder’s Office: Head to the recorder’s office in the county where the property is located. Most counties now also offer online access to public records, making it more convenient for you to perform a title search from home.

4. Start with grantor/grantee index: Look up the current owner’s name in the grantor/grantee index, which will provide a list of documents related to their transactions with the property.

5. Trace back through previous owners: Continue searching through historical documents for each previous owner listed on the property records until you have gone back at least 30 years or reached a clear title.

6. Examine deeds and conveyances: Carefully review all relevant deeds and conveyances, ensuring that they are properly executed and recorded. Take note of any inconsistencies, missing information, or other discrepancies.

7. Investigate liens and encumbrances: In addition to standard ownership documents, be sure to review any existing mortgage liens, tax liens, mechanic’s liens, easements, or other burdens affecting the property.

8. Check for unreleased liens: Ensure that any previously recorded liens have been legally released, especially if they no longer affect the property. Unreleased liens can cause complications in transferring the title.

9. Verify property tax status: Check with the county tax assessor’s office to confirm that property taxes are current and up-to-date. Delinquent taxes could result in additional liens or encumbrances.

10. Consult a professional if necessary: Performing a title search is a complex process that requires careful attention to detail. If you’re unsure about your findings or encounter issues beyond your expertise, consider hiring a professional title company or real estate attorney to assist you.

By following these 10 steps, you can confidently conduct a thorough title search and protect your investment. With proper due diligence, you’ll gain peace of mind and be better prepared for the real estate transaction ahead.
