4 Ways to Relinquish Parental Rights in Georgia

Introduction:

The decision to relinquish parental rights is never easy for any parent. However, in some cases, it may be best for the child’s well-being. In Georgia, there are four primary methods for voluntarily ending or modifying parental rights. Understanding these options will help parents make an informed decision.

1.Voluntary Termination of Parental Rights:

When parents mutually agree that one or both of them should surrender their parental rights, they may request a voluntary termination of parental rights. This typically occurs when one or both parents believe it is in the best interest of the child. The process involves filing a petition with the court, and both parents must sign the documents in front of a notary public. A court hearing will determine whether granting the termination request is in the child’s best interest.

2.Adoption:

Relinquishing parental rights can also occur during an adoption process. In such cases, both biological parents must consent to the adoption and sign a written agreement stating their intent to surrender their parental rights. The consenting parent(s) would no longer have legal responsibilities towards the child after the adoption is finalized.

3.Legitimation:

Legitimation is a legal process where an unmarried father establishes his parental rights for his child born out of wedlock. In some situations, mothers may choose to legally acknowledge a father’s parental rights and relinquish her own, transferring full custody and all responsibility to the father.

4.Dependency Case Termination:

If a dependency case has been filed against a parent due to allegations of abuse, neglect, or other unacceptable behavior towards their child that endangers their wellbeing, it may lead to termination of parental rights as well. While parents can contest these charges in court, they can also choose to voluntarily relinquish their parental rights during this process if they believe it is in the best interest of their child.
