Introduction: Changing your name can be a significant decision for many reasons, including marriage, divorce, or personal preference. In Virginia, there are several methods to legally change your name. This article will discuss four ways to accomplish a name change in Virginia, along with the necessary steps involved.

1.Name Change Due to Marriage

When getting married in Virginia, you have the option to change your last name by using your marriage license as evidence of a legal name change. Here’s how:

– Obtain a certified copy of your marriage license from the Circuit Court Clerk’s office where you received the license.

– Update your name on your Social Security card by visiting the Social Security Administration (SSA) office or mailing the required documents.

– Visit the Department of Motor Vehicles (DMV) to update your driver’s license or identification card with your new name.

– Notify other relevant institutions (banks, employers etc.) of your name change.

2.Name Change Due to Divorce

During a divorce process in Virginia, you can request to revert to a previous or maiden name. Here’s how:

– Request the court include a provision about the desired name change in the final divorce decree.

– Obtain a certified copy of the final divorce decree from the Circuit Court Clerk’s office.

– Follow similar steps as mentioned in case of marriage; update your records with SSA, DMV and other institutions.

3.Name Change by Petitioning for an Adult

If you are an adult seeking a name change in Virginia for reasons other than marriage or divorce, you must petition the Circuit Court. Here’s how:

– Fill out the “Application for Change of Name” form available at your local Circuit Court Clerk’s office.

– Undergo a background check and submit fingerprints to the Central Criminal Records Exchange.

– Pay appropriate fees and attend a scheduled hearing where a judge will decide on the name change petition.

– If approved, obtain a certified copy of the court order and update your records with SSA, DMV and other institutions.

4.Name Change for a Minor

To change the name of a minor in Virginia, a parent or legal guardian must petition the Circuit Court on behalf of the child. Here’s how:

– Fill out the “Petition for Change of Name (Minor)” form available at your local Circuit Court Clerk’s office.

– In cases where both parents are not filing jointly, serve notice to any non-filing parent via a court-approved method (i.e., certified mail or hiring a process server).

– Pay appropriate fees and attend a scheduled hearing where a judge will decide on the petition.

– If approved, obtain a certified copy of the court order and update the minor’s records with SSA, DMV (if applicable), and other institutions such as schools.

Conclusion

Regardless of the reason behind your decision to change your name in Virginia, following these four methods will help you successfully navigate and complete the process. Be sure to keep certified copies of all relevant documents, as they may be required when updating records with various organizations.
